Terms of Service

1. The service

NicheKite is a research tool for print-on-demand sellers, operated by the NicheKite team. It shows information about Amazon Merch on Demand listings (such as Best Sellers Rank, price, listing date and reviews), keyword statistics, a holiday calendar and a trademark lookup based on public USPTO records. NicheKite is independent and is not affiliated with, endorsed or sponsored by Amazon.

NicheKite is under active development. Features may change, be added or be removed.

2. Your account

• You sign in with Google or with a one-time code sent to your email. Give us an email address you control.
• An account is for one person. Keep access to it to yourself; you are responsible for what happens in your account. Teams should use team seats rather than sharing one login.
• An account may be limited to a set number of active sessions. Signing in on a new device can sign out an older session.
• You must be at least 16 years old and able to enter into this agreement.

3. Acceptable use

You agree not to:

• copy, scrape, download in bulk, resell or republish NicheKite's data or build a competing dataset from it;
• access the service by automated means other than the features we provide, or try to get around limits, plans or security;
• use NicheKite to copy other people's designs or to infringe trademarks, copyright or other rights;
• interfere with the service or other users, or use it for anything unlawful.

We may suspend or close accounts that break these rules. Where reasonable, we will tell you why first.

4. The data and its limits

• Product data describes Amazon Merch listings (BSR, prices, reviews, launch dates) and is updated at intervals, not in real time. It can be delayed, incomplete or wrong.
• Best Sellers Rank is a relative ranking, not a sales figure. NicheKite does not tell you how many units a design sells.
• The trademark checker compares text with public USPTO records. It does not cover every country, copyright, licensed characters, publicity rights or Amazon's content policy, and it is not legal advice.
• You make your own design, listing and business decisions. Check anything important at its source.

5. Intellectual property

NicheKite's software, design and original texts (such as guides and calendar notes) belong to us. Product images, titles and designs shown in the app belong to their respective owners and are shown for research only; you may not reuse them. Amazon, Merch by Amazon and Merch on Demand are trademarks of Amazon.com, Inc. or its affiliates. Notes and collections you create remain yours; you allow us to store and process them to run the service.

6. Plans and payments

• Paid plans, their prices and what they include are shown on the pricing and billing pages before you pay. Prices may change for future periods; a change never applies to a period you have already paid for.
• You can pay by VietQR bank transfer (matched to your order through SePay) or by PayPal. We never receive or store your card details.
• A plan starts when your payment is confirmed and runs for the period you bought. Plans do not renew automatically unless the checkout clearly says so.
• Refunds: the refund terms are shown at checkout. If something went wrong with a payment, write to [email protected] and we will sort it out.

7. Cancellation and termination

You can stop using NicheKite at any time and ask us to delete your account by writing to [email protected]. We may stop offering the service, or part of it, with reasonable notice; if we do, we will refund the unused part of any paid period.

8. No warranty

NicheKite is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be uninterrupted, error-free or fit for a particular purpose, or that any niche, design or listing will sell.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, rejected or removed listings, or account actions taken by Amazon or other platforms. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms. We will post the new version on this page with a new date and, for material changes, tell signed-in users before they take effect. Continuing to use NicheKite after that means you accept the new terms.
